Terms and Conditions

These Terms and Conditions ("Terms") apply to your use of https://start.alturafunding.com, https://fund.alturafunding.com and any related pages that link to these Terms (together, the "Site"), which are operated by APR Collective Estates LLC DBA Altura Funding ("Altura Funding," "we," "us" or "our").

By using the Site, submitting a form or booking a call, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.

Altura Funding is a business funding consulting and advisory company. We are not a lender, and we do not make loans or extend credit. We help business owners and real estate investors understand their options and prepare to apply for funding from third-party lenders and funding providers.

Information on the Site, on calls and in our materials is for general informational purposes only. Altura Funding does not promise or guarantee funding approval, any funding amount, any interest rate or terms, or any timeline. All funding decisions, including whether you are approved, how much and on what terms, are made only by third-party lenders and funding providers under their own criteria. Results vary from client to client.

Nothing on the Site is legal, tax, accounting or credit-repair advice. Talk to a qualified professional about your situation.

You must be at least 18 years old to use the Site. You agree that the information you give us is true, accurate and yours to share. If you give us a phone number or email address, you confirm that you are the owner or an authorized user of it.

When you check the consent box on our form, you agree to receive calls, text messages (including automated and AI-assisted messages) and emails from Altura Funding about your funding inquiry at the phone number and email you provided.

• Consent is not a condition of purchase. You don't have to agree to receive messages to buy any product or service from us.
• Message frequency varies.
• Message and data rates may apply, according to your mobile carrier plan.
• To opt out, reply STOP to any text message from us, sent to the same phone number the message came from. We will send one message confirming that you have been unsubscribed, and after that you will stop receiving text messages from us. You can also ask us to stop calling you, or unsubscribe from emails using the link in the email.
• For help, reply HELP to any text message from us, or contact us at info@alturafunding.com or 216-550-8573.
• Carriers are not liable for delayed or undelivered messages.
• If you change or give up the phone number you provided, let us know so we don't message the new owner of that number.

How we handle your phone number and messaging consent is described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Booking a call or submitting a form does not create a paid engagement. Paid services are governed by your separate client agreement with Altura Funding. If these Terms conflict with your client agreement, your client agreement controls for the paid services.

You agree not to:

• Submit false information or information about someone else without their permission
• Use the Site for any unlawful, fraudulent or harmful purpose
• Try to interfere with, damage or gain unauthorized access to the Site or our systems
• Copy, scrape or reuse Site content for commercial purposes without our written permission

The Site and its content, including text, graphics, logos and videos, belong to Altura Funding or its licensors and are protected by copyright, trademark and other laws. You may view the Site for your own personal, non-commercial use.

The Site may use or link to third-party services, such as scheduling tools, payment pages and lender or partner websites. We don't control them and aren't responsible for their content, policies or practices. Your use of them is subject to their own terms.

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Site will always be available, error-free or secure.

To the fullest extent permitted by law, Altura Funding and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, lost funding opportunities or lost data, arising from or related to your use of the Site. To the fullest extent permitted by law, our total liability for any claim related to the Site is limited to $100. Some states don't allow certain limitations, so some of these may not apply to you.

You agree to defend and hold harmless Altura Funding from any claims, losses or expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules. Any dispute related to these Terms or the Site will be brought in the state or federal courts located in Cuyahoga County, Ohio, and you agree to their jurisdiction.

We may update these Terms from time to time. When we do, we will post the new version on this page and update the effective date above. Changes take effect when posted. If you keep using the Site after a change, you accept the updated Terms.
